Please read these Terms of Service (“Terms”) carefully before using the Diet Coach mobile application (the “App”). By using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Diet Coach, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
2. Description of Service
Diet Coach is a mobile application that helps people managing their diet:
- Set daily and weekly calorie budgets
- Log meals and snacks against those budgets
- Track weight, BMI, waist, and glucose measurements
- Visualise progress with charts and adherence heatmaps
- Receive supportive nudges and encouragement
The App is provided as a tool for informational and personal wellbeing purposes only.
3. Disclaimer — Not Professional Advice
Diet Coach does not provide professional medical, nutritional, or dietary advice. The information, recommendations, and suggestions provided by the App are for general informational purposes only and should not be relied upon as a substitute for professional advice.
You are solely responsible for your own health and wellbeing. Always consult qualified healthcare professionals before making significant changes to your diet, exercise routine, or treatment plan — particularly if you have a medical condition such as diabetes, an eating disorder, or are pregnant.
4. User Accounts
If the App requires account creation:
- You must provide accurate and complete information
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorised use of your account
We reserve the right to suspend or terminate accounts that violate these Terms.
5. User Responsibilities
When using Diet Coach, you agree to:
- Use the App only for lawful purposes
- Not attempt to reverse engineer, decompile, or disassemble the App
- Not interfere with the App’s operation or infrastructure
- Not use the App to distribute malware or harmful content
- Not scrape, harvest, or collect data from the App by automated means
- Comply with all applicable laws and regulations
6. User Content
You retain ownership of data you enter into Diet Coach (meal logs, calorie budgets, weight and health metric entries, notes, etc.). By using the App, you grant us a limited licence to store, process, and display this data solely for the purpose of providing the App’s services to you.
7. Intellectual Property
The App, including its design, code, graphics, logos, and content (excluding user-generated content), is owned by Working From Home Unlimited and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App without our prior written consent.
8. Third-Party Services
The App may integrate with or link to third-party services. We are not responsible for the content, policies, or practices of third-party services. Your use of third-party services is subject to their respective terms and policies.
9. Availability and Modifications
We strive to keep Diet Coach available and up-to-date, but we do not guarantee uninterrupted access. We reserve the right to:
- Modify, suspend, or discontinue any feature of the App at any time
- Perform maintenance that may temporarily limit availability
- Update these Terms with reasonable notice
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- Diet Coach is provided “as is” and “as available” without warranties of any kind, whether express or implied.
- We do not warrant that the App will be error-free, secure, or continuously available.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
- Our total liability to you for any claims arising from use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $50, whichever is greater.
- We are not liable for any adverse health outcomes, weight changes, or other losses resulting from actions taken based on information provided by the App.
11. Indemnification
You agree to indemnify and hold harmless Diet Coach and its developers from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.
12. Termination
We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination:
- Your right to use the App ceases immediately
- We may delete your account and data in accordance with our Privacy Policy and Data Protection policies
You may stop using the App and delete your account at any time.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and Data Protection notice, constitute the entire agreement between you and Diet Coach regarding your use of the App.
